Request for Medical Marijuana Fatwa (sent to Islamic authority in USA)

Text of email sent to the Association of Islamic Charitable Projects today. I will wait for their response insya'Allah.

Assalamu'alaikum brothers.

We need a fatwa on this issue of medical marijuana. There are many prescription drugs used by doctors today which are far more intoxicating, addictive and dangerous than prescription medical marijuana.

I believe a fatwa should be issued quickly regarding this issue so that Muslim patients dying of cancer or suffering from serious diseases can rest assured that they are not committing haram by using prescription medical marijuana to manage their severe pain and nausea caused by cancer and cancer chemotherapy and other serious diseases.

I cannot find a fatwa anywhere on the internet but I am aware that Islam allows for the use of opiates (morphine, oxycodone, codeine), stimulants such as amphetamines (Adderall, Dexedrine), methylphenidate (Ritalin), benzodiazepine tranquilizers (diazepam/Valium, alprazolam/Xanax) and other khamr for the treatment of serious illnesses.

For example, I have been on diazepam (Valium) for 20 years and it causes drunkenness in high doses or when abused by normal people. I am on Valium for panic disorder and other stress disorders which are severe.

Please give fatwa about medical marijuana. I have tried 20 different medications and my doctor said that he cannot help me anymore because I cannot tolerate conventional medications such as SSRIs or tricyclic antidepressants. I have too many side effects and one of them caused my stomach to bleed resulting in hospitalization and could have killed me. They are also extremely addictive.

I am aware that medical marijuana can be used in 14 US states under a doctor's supervision when the other medications have failed.

I suffer from panic disorder, PTSD (post-traumatic stress disorder), treatment-resistant/treatment-refractory mental depression (severe depression), and OCD (obsessive-compulsive disorder).

I have read conclusive scientific evidence that low doses of medical marijuana can treat depression and stress effectively without causing any more intoxication than diazepam (Valium) currently does. Valium, the drug I am legally prescribed and have taken for 20 years by prescription, causes me memory loss, rage/anger, forgetfulness, addiction (cannot stop without having severe withdrawal symptoms), laziness and apathy. These effects I am sure are worse than low doses of cannabis (medical marijuana).

I would like to use medical marijuana in the lowest effective dose from my physician. 

I am sorry for the long email but I don't want to be committing haram. Please keep in mind that chronic pain patients and some people with my condition are prescribed highly addictive and dangerous opiates (narcotics such as codeine or hydrocodone) in severe cases as Dr. Stuart Shipko, MD told me. I do NOT want to take narcotics such as opiates. 

I feel that marijuana is safer.
